关于《中国禁止出口限制出口技术目录》的调整及其影响的初步分析

对技术出口实行负面清单管理是国际通行规则，也是当下中国出口管理执法的重要依据。2001年，中国在加入世界贸易组织后，为与国际规则接轨并规范技术进出口管理，出台了《中华人民共和国技术进出口管理条例》（现行版本为2019年修订版），并由原对外经济贸易部与科学技术部据此法编制了首版《中国禁止出口限制出口技术目录》（以下简称《目录》），建立起中国技术出口的负面清单管理制度。

2020年8月28日，商务部与科技部联合发布了新版《目录》。此次调整是2008年《目录》首次修订以来的第二次修订。本文将介绍此次目录调整的主要内容，同时分析其对技术出口的影响，以供从事技术贸易的中国企业参阅。
