The results of 2017 Top 10 Medical Health Cases in “China Lawyer Contest” were published on April 29, 2018. Shen Tao, the lawyer from our Shanghai office who presented “FENG’s medical malpractice dispute”, was one the winners.
“China Lawyer Contest” is spearheaded by Lawyers in Media, supported by Beijing Association of Intellectual Property, Institute of Legal Practice of Remin University as well as Research Centre of Environment and Resources Law of China University of Political Science and Law, and organized by Beijing Legal Media Bridge Consulting Co., Ltd. A wide range of cases have entered the contest this year. The selection process includes online polling and expert votes. The social influence, complexity and representation challenges are the primary factors that determine which case eventually gets shortlisted.
Doctor-patient conflicts, and medical injury compensation have sparked a series of social debates and have become a challenge for hospitals and medical administrators. This case, titled “FENG’s medical malpractice dispute” involves damages caused by medical malpractice and disputes of medical service contract. The parties in question sued each other over damage compensation and hospitalization expenses. At the same time, the hospital was trouble by the fact that FENG, who was in a vegetative state, has long occupied an ICU bed. The case highlights this aggravating social problem and delves into medical compensation and disputes caused by malpractice. It is going to serve as a classic example for other similar cases, and will help promote the role of rule of law.
